Terms of Service

Overview

These Terms of Service govern your use of tommitchelldigital.com and the purchase of any services offered by Tom Mitchell Digital (TMD), operated by Tom Mitchell, Ottawa, Ontario, Canada.

By using this site or purchasing a service, you agree to these terms. If you do not agree, do not use the site or purchase services.

Services

TMD offers the following services:

  • Profit Path Briefa 48-hour async revenue path diagnostic ($399)
  • Profit Path Mapa full path diagnostic delivered in 3–4 business days ($1,200)
  • Profit Path Buildscoped implementation engagement, priced from findings (from $3,500)
  • Profit Path Operatorretained path operations ($2,000/month base + performance component)

All services are delivered by Tom Mitchell Digital. Diagnostic judgment, findings, and strategic recommendations are provided by Tom Mitchell. Supporting research, analysis, and drafting may be performed by trained assistants or AI-assisted systems operating under Tom Mitchell's direct supervision and review. Scope, deliverables, and timelines for each service are described on the relevant service pages at tommitchelldigital.com/services.

Purchases and payment

All purchases are processed securely via Stripe. By completing a purchase you agree to Stripe's terms of service at stripe.com/legal.

Prices are listed in USD unless otherwise stated. TMD reserves the right to update pricing at any time. Price changes do not affect purchases already completed.

Refund policy

Profit Path Brief ($399)

Due to the time-intensive nature of diagnostic work, refunds are not offered once the intake form has been submitted and work has commenced. If you purchase the Brief and do not submit your intake form within 30 days, you may request a refund by contacting tom@tommitchelldigital.com.

Profit Path Map ($1,200)

No refunds once diagnostic work has commenced. If you have purchased the Map and have not yet submitted your intake, contact tom@tommitchelldigital.com within 14 days to request a refund.

Profit Path Build and Operator

Refund terms for Build and Operator engagements are specified in the individual engagement agreement provided prior to commencement of work.

If you have a concern about a delivered service, contact tom@tommitchelldigital.com and TMD will work to resolve it in good faith.

Delivery and timelines

  • Profit Path Brief: delivered within 48 hours of intake form completion
  • Profit Path Map: delivered within 3–4 business days of intake form completion
  • Profit Path Build: timeline specified at time of scoping
  • Profit Path Operator: ongoing, with weekly briefs and monthly reviews

Timelines begin upon receipt of a completed intake form, not upon payment. TMD will notify you if a delay is anticipated.

Intellectual property

All content on tommitchelldigital.com — including copy, methodology descriptions, frameworks, sample findings, and design — is the intellectual property of Tom Mitchell Digital and may not be reproduced, distributed, or used without written permission.

Deliverables produced for you as part of a purchased service (Brief, Map, Build) are licensed to you for use in your business. TMD retains the right to use anonymized and de-identified findings as examples or case studies.

Confidentiality

TMD treats all client information submitted via intake forms and engagement communications as confidential. Information is not shared with third parties except as necessary to deliver the service (e.g. payment processing via Stripe).

Any findings, reports, or deliverables produced for you are intended for your internal business use. TMD may reference anonymized findings publicly without identifying the client.

Limitation of liability

TMD provides diagnostic and advisory services. Recommendations and findings are based on the information provided and TMD's professional judgment. TMD does not guarantee specific revenue outcomes or business results.

To the maximum extent permitted by applicable law, TMD's liability for any claim arising from a service is limited to the amount paid for that service.

TMD is not liable for indirect, incidental, or consequential damages of any kind.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada, unless otherwise required by applicable consumer protection law in your jurisdiction.

Users in the United Kingdom, Australia, New Zealand, and the United States retain any rights afforded to them under their local consumer protection laws that cannot be excluded by contract.

TMD does not share subscriber information with third parties for marketing purposes.

Changes to these terms

TMD may update these terms from time to time. Material changes will be noted by updating the “Last updated” date at the top of this page. Continued use of the site after changes constitutes acceptance of the updated terms.
